ASTOR Online Store Regulations

1. General Provisions


1.1 These ASTOR Online Store Regulations define the rules for using the ASTOR Online Store. These Regulations constitute an integral part of the ASTOR Internet Services Regulations. Any issues not addressed in these Regulations shall be governed by the provisions of the ASTOR Internet Services Regulations.

1.2 The ASTOR Online Store is available at: www.astor.com.pl/store.

1.3 The ASTOR Online Store sells Goods and e-training via the Internet.

1.4 Purchases in the ASTOR Online Store can only be made for purposes directly related to business or professional activities conducted by the Users making the purchases.

1.5 ASTOR may reserve the right to withhold the purchase of some of the Goods at the ASTOR Online Store which are exclusively for Users who are resident on the territory of the Republic of Poland. These provisions refer to a situation where selling Goods to a User with a seat outside the Republic of Poland would violate the law or provisions of agreements concluded by ASTOR with the producers or distributors of the Goods.

1.6 Information about the Goods and e-training placed on ASTOR websites does not constitute an offer as defined by the Civil Code, rather an invitation to make offers.

1.7 All prices displayed on the ASTOR Online Store website are in PLN. These prices do not include the cost of sending the Goods to the User. Information on the cost of delivery of goods is available at: http://www.astor.com.pl/store/conditions-of-delivery.html

1.8 ASTOR is entitled to change the prices of the Goods and e-training placed on the ASTOR Online Store website, modify the range of products, remove the Goods or e-training, add new Goods or e-training, conduct and cancel promotional campaigns at the ASTOR Online Store website, and make changes thereto. The prices given on the website of ASTOR Online Store are binding from the moment of placing an order by the User.

1.9 In the case of sales promotions and sales, special prices are available for a limited number of Goods. Orders for goods which are part of sales promotions and sales are fulfilled in the order that they have been confirmed until the stocks covered by special conditions are exhausted.

2. Placement of orders and conclusion of the agreement


2.1 Orders for Goods and e-training are accepted only via the transaction system available at the ASTOR Online Store, and are processed in the order they are received. Orders placed with the ASTOR Online Store in any other form (including phone, fax, email) shall not be fulfilled.

2.2 To place an order to purchase Goods or e-training, you need to fill in the order form available on the ASTOR Online Store website and accept the ASTOR Internet Service Regulations as well as the Regulations described here. If you purchase Goods, you also need to accept the ASTOR General Terms of Liability for Defects in Goods. The order form must include complete data for the User making the purchase, including VAT number. If the order form is not filled in correctly, ASTOR has the right to withhold the order or cancel it.

2.3 Once the order is placed by the User, ASTOR Online Store provides the User with a confirmation of order acceptance via e-mail.

2.4 Payment for the order can be made upon receipt of confirmation of order acceptance, by bank transfer or electronic payment via the PayU.pl system, and in the case of choosing personal collection of the Goods, also in cash at ASTOR's premises at ul. Smoleńsk 29 in Kraków, upon collection of the Goods by an authorized person.

2.5 The Agreement for purchase of Goods or services is concluded when the User makes payment for the order. In a case where the User has chosen payment upon collection of the Goods, the contract is concluded at the moment the User receives confirmation of the order, provided that the payment is made and the Goods are collected within 3 working days of the date of the User receiving confirmation of the order.

2.6 If the Goods ordered by the User are not available in the warehouse of ASTOR Online Store, the User is informed about the expected delivery time of the order in a message sent via e-mail to the address given in the order form. After receiving an e-mail with information about possible order delivery time, the User, in order to purchase the Goods, is obliged to place the order again for the Goods covered by the information.

2.7 If, despite the unavailability of the ordered Goods, the User receives confirmation of order acceptance and pays for the order, ASTOR is entitled to withdraw from the contract. If ASTOR withdraws from the contract, it is obliged to return the amounts paid by the User immediately to the account from which the payment was made. The statement of withdrawal shall be sent to the User via e-mail to the address given on the order form. ASTOR shall also inform the User about the possible time of order completion. In order to purchase the Goods, the User is obliged to place the order again for the Goods covered by the information.

3. Order completion and payment terms


3.1 If an order to purchase Goods or an e-service is placed and paid before 1:00 p.m. on a business day, it is processed by the ASTOR Online Store on the same day.

3.2 If an order to purchase Goods or an e-service is placed and paid at 1:00 p.m. or later on a business day, or at any time on a Saturday or a holiday, the order is processed on the next business day.

3.3 If the User has chosen the option to pay upon personal collection of the Goods, then collection of the Goods shall be possible after the User has received confirmation that the Goods are ready for collection. Goods can only be collected at ASTOR's premises at ul. Smoleńsk 29 in Krakow.

3.4 The Order shall be considered paid upon:

    • a) the bank transfer being credited to ASTOR's bank account (for traditional bank transfers),
      b) receiving information from PayU.pl that the order has been paid (in the case of PayU.pl electronic online transfers),
      c) payment of the outstanding amount at ASTOR's premises referred to in clause 3.3 to the person authorized to collect such payments, and issuance of a receipt by that person (in the case of payment upon personal collection of the Goods).
  • 3.5 Completion of the order, referred to in clauses 3.1 and 3.2, concerning the sale of Goods means that ASTOR has delivered the ordered Goods to the courier company for delivery to the User purchasing the Goods. The ordered Goods are shipped in Poland by a courier company chosen by ASTOR. The cost of sending the Goods shall be borne by the User purchasing the Goods.

    3.6 ASTOR chooses the courier company, which, under normal circumstances, usually delivers parcels on the next working day after they are dispatched by ASTOR. However, ASTOR is not responsible for late delivery of the Goods to the User.

    3.7 Order completion referred to in clauses 3.1 and 3.2 regarding e-training means that the User is granted temporary access to an online course in the form of videos presenting knowledge within a specific field.

    3.8 The e-training is made available to the User by sending a message with a link to the e-training via email to the address given in the order form.

    3.9 The e-training is made available to the User for 1 year. The term of access to this online course commences at the moment when the message confirming that the e-training has been made available to the User, referred to in item 3.8, has been received by the User.

    4. Final provisions


    4.1 All materials contained in e-training, including text, photographs, graphics, movies, sounds and the selection and arrangement of content and graphics constitute works and are subject to protection pursuant to the Act on Copyright and Related Rights of 4th February 1994, the Act on Protection of Databases of 27th July 2001 and international conventions to which the Republic of Poland is a party. The User who has purchased the e-training is not entitled to make it available to any third parties, except to persons employed by him/her. The User has no right to consolidate, multiply or disseminate the e-training or any part thereof.

    4.2 Any issues related to ASTOR's liability for defects of purchased GOODS are regulated in ASTOR's General Terms of Liability for Defects in Goods. Complaints relating to e-training services shall be submitted and processed in accordance with the ASTOR Internet Service Regulations.

    4.3 After logging into his/her account, the User has access to the content of the Regulations, the ASTOR Online Store Regulations, and ASTOR's General Terms of Liability for Defects in Goods accepted by him/her.

    4.4 ASTOR processes the User's personal data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).     4.5 When Goods are purchased at the ASTOR Online Store, ASTOR Technical Assistance Units are charged under the conditions specified in the Technical Assistance Regulations which also indicate the rules for including the purchased Goods within the scope of ASTOR Technical Assistance.

    4.7 These Regulations shall be effective as of 1.03.2016.
